Overview & Legal Status

South Dakota launched a medical cannabis programme in 2021 after Measure 26 (2020) was approved by 70% of voters. Constitutional Amendment A (which also included adult-use) was separately invalidated by the SD Supreme Court. Adult-use cannabis is illegal. SDCL § 34-20G governs medical cannabis.

Medical Patient Possession

  • Registered patients may possess up to 3 oz of usable cannabis per 14-day period
  • Must carry South Dakota Medical Cannabis Card + government-issued ID

Adult-Use Possession

  • Any marijuana possession without medical card is illegal

  • Approved laboratories: State-licensed, ISO/IEC 17025 accredited; independent of producers and retailers
  • Certificate of Analysis (COA) must accompany each batch; accessible to patients/consumers on request
  • SD Dept. of Health approves testing labs; ISO 17025 accreditation required

Adult-Use Cannabis

Adult-use cannabis is illegal in South Dakota. Constitutional Amendment A (2020), which included adult-use, was invalidated by the South Dakota Supreme Court in 2021 for being an unconstitutional revision (single-subject rule). Measure 27 (November 2022) — adult-use legalisation — was also defeated by voters (53% against).

Differences from Medical Use

  • Medical programme active; adult-use has no legal pathway
  • No adult-use tax framework has been developed
  • Medical 3 oz/14 days; adult-use any possession illegal
  • Legislative and ballot initiative prospects for adult-use remain challenging

Local Ordinances

  • Sioux Falls and Rapid City enforce state law
  • South Dakota Tribal Nations: some Sioux tribes operate on-reservation cannabis programmes under tribal sovereignty — complex jurisdictional issues

⚠️ Adult-Use Cannabis — Important Warnings

  • Adult-use cannabis is NOT legal in South Dakota. Possession, sale, and cultivation outside the medical programme remains a criminal offence.
  • Medical cannabis patients must carry their state-issued registry card at all times when possessing cannabis.
  • Cannabis cannot be transported across state lines — this is a federal offence regardless of destination state laws.
  • Do not drive or operate machinery while impaired by cannabis — DUID laws are strictly enforced.
  • Airports operate under federal jurisdiction — carrying cannabis through airports is prohibited.
  • Cannabis is prohibited on all federal lands (national parks, forests, federal buildings).
  • Keep all cannabis and CBD products out of reach of children and pets.
  • Cannabis use during pregnancy or breastfeeding is strongly discouraged by health authorities.
